§1 Definitions

- Service User/User – a natural person, legal entity, or organizational unit without legal personality using the Service
- Service – the znajdzwypozyczalnie.pl website available at https://znajdzwypozyczalnie.pl
- Advertisement – publication of rental company information including contact details, photos, and service descriptions
- Account – individual User account in the Service, enabling Advertisement management
§2 General Provisions
These Terms and Conditions define the rules for using the znajdzwypozyczalnie.pl Service, including conditions for publishing Advertisements and the rights and obligations of Users. The Service is a marketplace platform enabling the publication and browsing of rental company advertisements. The Service Provider does not mediate in concluding rental agreements between Users and end customers.
§3 Registration and Service Use
- Using the full functionality of the Service requires creating an Account through registration
- Registration is possible through a registration form (email + password) or via Google account
- After registration, a verification link will be sent to the provided email address
- By registering in the Service, the User accepts these Terms and Conditions and the Privacy Policy
- The User is obliged to provide truthful personal/business data
- The User is responsible for maintaining the confidentiality of Account login credentials
§3A Prohibited Content and Content Moderation
The User agrees not to post in the Service, particularly in Advertisements, content that:
- Violates applicable Polish, EU, or international law
- Infringes on third-party rights, including copyrights, trademarks, trade secrets, or personal rights
- Is offensive, vulgar, discriminatory, promotes violence or hatred
- Is misleading, contains false information, or constitutes unfair competition
- Contains viruses, malicious software, or code that could harm the Service or other Users
- Constitutes spam, unwanted advertising, or marketing activities unrelated to rental business
Service Provider's Rights:
- The Service Provider reserves the right to immediately remove or block access to Advertisements and other content that violates these Terms and Conditions, applicable laws, or good morals
- Content removal may occur without prior notice to the User, especially when the content constitutes an obvious violation of law or these Terms and Conditions
- In case of serious or repeated violations, the Service Provider may suspend or permanently delete the User's Account
- Removal of an Advertisement or Account suspension due to Terms and Conditions violation does not result in a refund for paid services
Reporting Violations:
Users can report content violating the Terms and Conditions to the email address: [email protected]. The report should include a description of the violation and a link to the problematic content. The Service Provider will review the report within a reasonable time.
User Responsibility:
The User bears full legal responsibility for all content they post in the Service. The User agrees to compensate for any damages that the Service Provider may incur in connection with the User's violation of this paragraph, including legal proceeding costs.
§4 Pricing and Payments
Publishing an Advertisement is a paid service. The Service offers various pricing plans that differ in the scope of advertisement visibility and functionality. Detailed descriptions of available plans, publication periods, and current prices are available on the dedicated Pricing page in the Service. Payments are processed through the Stripe payment system. Prices shown in the pricing are net prices. Applicable VAT tax must be added to each price in accordance with regulations.
§5 Right of Withdrawal from Contract
In accordance with Article 38, point 13 of the Consumer Rights Act, the right to withdraw from a distance contract does not apply to consumers in the case of:
Contracts for the supply of digital content not delivered on a tangible medium, if the performance has begun with the express consent of the consumer before the withdrawal period expires and after the entrepreneur has informed them of the loss of the right to withdraw from the contract.
Publication of the Advertisement occurs immediately after payment, with the express consent of the User expressed by checking the appropriate checkbox before making the payment. Therefore, the User loses the right to withdraw from the contract.
For entrepreneurs (B2B), the right of withdrawal does not apply.
§6 Electronic Invoices
By accepting these Terms and Conditions, the User consents to the issuance and sending of invoices in electronic form, in accordance with Article 106n of the Value Added Tax Act. Invoices will be made available to the User for download in their account panel in the Service.
§7 Liability
- The Service Provider provides a marketplace platform service and is not responsible for the content of Advertisements published by Users
- The Service Provider is not a party to contracts concluded between Users and their customers
- The User bears full responsibility for the content of published Advertisements and for compliance with applicable laws
- The Service Provider will make efforts to ensure the Service operates continuously, however does not guarantee continuous access
- The Service Provider is not liable for damages resulting from force majeure or actions of third parties
§8 Complaints
- The User has the right to submit a complaint regarding the operation of the Service
- Complaints should be submitted to the email address: [email protected]
- The complaint should include: name/company name, email address, problem description, and expected resolution method
- Complaints are processed within 14 business days from receipt
- The response to the complaint will be sent to the email address provided in the complaint
§9 Personal Data
Detailed information regarding the processing of personal data is contained in the Privacy Policy available in the Service.
§10 Final Provisions
- Matters not covered by these Terms and Conditions shall be governed by Polish law
- The Service Provider reserves the right to change the Terms and Conditions. Users will be informed of changes with 7 days' notice
- All disputes will be resolved by the court with jurisdiction over the Service Provider's registered office
- These Terms and Conditions enter into force on the date of publication in the Service
